1. Acceptance of Terms
By downloading, installing, or using Homecise ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
Homecise is a home fitness application designed primarily for older adults. The App provides exercise routines, workout tracking, health data recording, and medication logging features. The App is a personal fitness and data-recording tool only.
3. Exercise & Fitness Disclaimer
Homecise provides exercise suggestions based on your profile, equipment, and fitness level. These are general fitness suggestions, NOT medical prescriptions. Always consult your physician before starting any exercise program, especially if you have pre-existing health conditions, are recovering from surgery, or have been sedentary for an extended period.
4. Health Data Recording
The App allows you to record health measurements including blood pressure, blood glucose, weight, and heart rate. This feature is strictly a personal data-recording tool. The App does not interpret, evaluate, analyze, or provide any assessment of your health readings. The App will never indicate whether any reading is normal, abnormal, high, low, or concerning.
5. Medication Logging
The medication logging feature is for personal record-keeping purposes only. The App does not provide pharmaceutical guidance, recommend medication changes, warn about side effects, suggest drug interactions, or provide any form of medication advice. Always consult your pharmacist or physician regarding your medications.
6. No Medical Advice
Homecise is NOT a medical device, medical service, or healthcare provider. Nothing in this App constitutes medical advice, diagnosis, or treatment. The App does not replace professional medical care. Never disregard professional medical advice or delay seeking treatment because of information recorded in this App.
7. AI-Generated Content
The App uses artificial intelligence to generate workout plans and extract data from images (equipment scanning, medication labels, health readings). AI-generated content is provided for convenience only and may contain errors. AI features extract and organize data — they never interpret health data or provide medical recommendations.
8. Assumption of Risk
By using this App, you voluntarily assume all risks associated with physical exercise, including but not limited to: risk of injury from exercise movements, risk of falls during balance exercises, risk of cardiovascular events during physical activity, risk of aggravating pre-existing conditions, and risk of muscle or joint strain. You acknowledge that exercise carries inherent risks, particularly for older adults.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Homecise and its developers, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: your use of or inability to use the App, any injuries sustained during exercise, any reliance on health data recorded in the App, any errors in AI-generated content, or any other matter relating to the App.
10. Indemnification
You agree to indemnify, defend, and hold harmless Homecise and its developers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
11. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep your account information up to date. You are responsible for all activities that occur under your account.
12. Intellectual Property
All content, features, and functionality of the App (including but not limited to text, graphics, logos, exercise routines, and software) are the exclusive property of Homecise and are protected by copyright, trademark, and other intellectual property laws.
13. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason. Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the App settings.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.
